The problem hounding SMARTMATIC and TIM is really between them, which cannot be solved by any other entity, albeit the consequences will have tremendous impact on the whole country. From the news stories coming out, TIM's beef with SMARTMATIC has to do with control over the joint venture. This, therefore, points at the 60-40 ownership of the joint venture, which should have been established in their agreement, a required document submission. This is where the Special Bids and Awards Committee (SBAC) of the Commission on Elections comes in.
The TIM-SMARTMATIC joint venture agreement specified the 60%-40% arrangement in favor of the Filipino firm, TIM. But while this is clearly provided in the JVA provisions, it is the SBAC's role to verify such claim. From the document submissions of TIM-SMARTMATIC, there were some information that could have suggested inconsistencies with the JVA provision on 60-40 ownership. For instance, TIM's most updated general information sheet shows that it has capitalization of P400+ million. The joint venture agreement stipulates that the total capital of the joint venture is P1.2 billion, which means that TIM's share should be P720 million. This raises the question on TIM's financial capacity to contribute to the capitalization of the joint venture. It is the SBAC's role to have this verified - can TIM indeed comply with the share requirement given its financial capacity.
It appears from TIM's alleged reason for backing out, that there's an inconsistency between the in-paper and the de facto arrangement between TIM and SMARTMATIC. In paper, TIM has majority control of the joint venture via its 60% share ownership. Its recent claims, however, suggest the opposite. So, the question is "has there been misrepresentation in the document submissions?" If there is, then TIM-SMARTMATIC should have been post-disqualified, blacklisted, and moreover, be made to face civil and criminal sanctions as per Republic Act 9184 (Government Procurement Reform Act).

One of the candidates for Governor made some crime and this is what we called "vote buying". He payed the people for 2000php. I want the COMELEC to make alert in regards with this problem..We all know that it is a crime, if the leaders was the one who starts the crime,then what a follower saw they might follow it..
I want the help of the youth of today. We should be alert with this kind of crime. We will fight against the terror candidates..we should not be blind by the lies of the candidates,,what we wanted is a good leader,..
